Lawsuit filed for credit for "Nobody Greater"
« on: September 29, 2011, 01:28:03 PM »
My wife sent me this.  I'm sure it happens in the gospel music industry, but it took a song (and monetary amount) of this magnitude for it to make headlines.

Yeah, that's been circulating on Twitter for a few weeks now. The songwriter is a long time friend of mine. Although you never know a whole story, I have no doubt that Darius wrote that song himself.

That kind of stuff happens in Atlanta all the time, but people don't file lawsuits unless there's big money at stake. Folks put an "ooh" in a song and want writer's credits for it. SMH.

 Wow.

OAN: I wonder if Travis Malloy is related to Donald Malloy?

The church world in Atl is very small.

And the music circle is MUCH smaller.

(But for validation, Darius is from Nathan Simmons' church and my ex did P&W there on occasion, and Darius did P&W for us at our church on occasion. Plus, that church is the "go to" church for all holidays and Sunday night services. LOL. He is a PHENOMENAL P&W leader - and a great preacher too, as you might tell from Nobody Greater).

Yeah, the scene is kinda small here too. There are maybe 3 or 4 major circles and chances are you'll know a lot of people from both.

On subject, I find the timing to be suspect. I could be biased, but I don't think I am. JPK, Kevin Bond, Jason Nelson, and a few other celeb artists went IN on this dude on Twitter pretty much saying the same thing I thought to myself. And they all said that they had been there before, so it's not that uncommon.

This song has been recorded and credited to Darius for umpteen zillion years. Now, with a Stellar and a Grammy nomination, the guy wants to sue?

IDK but I love that song.  I was so excited when I learned to play it.  I only sang it once, but I've been practicing to be less nervous and flow a little better.  #totallyunrelated

Dorinda got sued behind her first album and lost, it really threw her for a curve... she had a hard time recovering from that one.

Case Index #11-CV-6075RJS
old link ... from january

it appears Mr. Malloy did a press release ...  :-\

http://www.free-press-release.com/news-stellar-award-nominated-songwriter-darius-paulk-admits-travis-malloy-involvment-of-vashawn-micthell-s-hit-song-nobody-greater-1326435106.html

Quote
“Mr. Paulk has said in the press that Mr. Malloy was not involved in the creation of the song Nobody Greater. That is well documented. However, in a court filing on December 22, 2011 Mr. Paulk now states and informed the Federal Court that in his opinion, Mr. Malloy did create the accompaniment of music to Nobody Greater. This strikes me as a very different position, in my opinion.” Said Brown. If that is in fact true, there is no identification on album credits of Mr. Malloy’s involvement in the song, production or otherwise.

Does it matter that Malloy probably had some part in writing this press release ... conflict of interest smh

Only melody and lyrics get credited in songwriting and copyright.
It doesn't matter if the chord arrangement and guitar/bass/drum/keys licks were all SLAMMIN', the copyright for any given song ultimately comes down to the lyrics and the melody.
If Mr. Paulk wrote the lyrics and melody and Mr. Malloy composed, arranged, produced, recorded, etc...all of the music, Mr. Paulk gets the copyright and Mr. Malloy gets paid for his time and efforts but no copyright.
That's just how it is.
Music theory is not always music reality.

That's good to know. lol Now Im thinking about all the want be producers that I jammed with. I have wrote some songs and one sister sang one of them in church a few times. I have thought that I dont really care about all that but on the other hand I have thought what if someone takes this song and it becomes a hit. Quite a delima in gospel music. :)

Seems like now it would be better to copyright your music, make a CD, sell it online, perform it live locally, then if someone takes it and makes it famous you got plenty of proof. :)
